Welcome to Fluffers. These Terms and Conditions ("Terms") govern your use of our website and the purchase of products from Fluffers ("we", "us", or "our"). By accessing our website or placing an order, you agree to be bound by these Terms.

1.1. These Terms apply to all orders placed through our website for delivery to Australia and New Zealand.

1.2. We reserve the right to amend these Terms at any time. Changes will be effective immediately upon posting to our website.

1.3. By placing an order, you confirm that you are at least 18 years of age or have parental/guardian consent to make a purchase.

2. Orders and Acceptance

2.1. All orders are subject to acceptance by Fluffers. We reserve the right to refuse or cancel any order at our discretion.

2.2. When you place an order, you will receive an email acknowledgment. This does not constitute acceptance of your order. Acceptance occurs when we dispatch your goods.

2.3. We reserve the right to limit quantities purchased per person, household, or order.

3. Pricing and Payment

3.1. All prices are displayed in Australian Dollars (AUD) unless otherwise stated.

3.2. Prices are subject to change without notice. The price charged will be the price displayed at the time your order is accepted.

3.3. Prices include GST where applicable but exclude shipping costs unless stated otherwise.

3.4. Payment must be made in full at the time of ordering using one of our accepted payment methods.

3.5. We are not responsible for any fees charged by your financial institution.

4. Shipping and Delivery

4.1. We ship to addresses in Australia and New Zealand only.

4.2. Delivery timeframes are estimates only and not guaranteed. We are not liable for any delays caused by courier services or circumstances beyond our control.

4.3. Shipping costs are calculated at checkout and vary based on destination and order size, but generally most customers can expect to receive their items within 3-7 business days.

4.4. Risk of loss and title for products pass to you upon delivery to the carrier.

4.5. You must provide accurate delivery information. We are not responsible for orders delivered to incorrect addresses provided by you.

4.6. If no one is available to receive delivery, the courier may leave a card with collection instructions. Uncollected parcels returned to us may incur re-delivery fees.

5. Returns and Refunds

5.1. Our returns policy complies with the Australian Consumer Law and New Zealand Consumer Guarantees Act.

5.2. You may return products anytime with a receipt if they are in used, or original condition.

5.3. To initiate a return, please contact us with your order number and reason for return.

5.4. Return shipping costs are the responsibility of the customer unless the product is faulty or we sent the wrong item.

5.5. Refunds will be processed within 14 days of receiving the returned goods, using the original payment method.

5.6. A statement as to why the product was unsatisfactory is mandatory, so that we can improve our customer experiences. 

6. Consumer Guarantees

6.1. Our products come with guarantees that cannot be excluded under the Australian Consumer Law or New Zealand Consumer Guarantees Act.

6.2. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

6.3. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

7. Intellectual Property

7.1. All content on our website, including text, graphics, logos, images, and software, is the property of Fluffers and protected by copyright and trademark laws.

7.2. You may not reproduce, distribute, or use any content without our prior written permission.

9. Limitation of Liability

9.2. Our total liability for any claim arising from your purchase shall not exceed the amount you paid for the product.

9.3. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence or any other liability that cannot be excluded by law.

10.1. These Terms are governed by the laws of Australia. For customers in New Zealand, local consumer protection laws also apply.

10.2. Any disputes arising from these Terms or your purchase shall be subject to the exclusive jurisdiction of the courts of Australia, or New Zealand as applicable.

10.3. We encourage you to contact us first to resolve any disputes informally.

11. Force Majeure

11.1. We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, pandemics, or industrial action.

12. Severability

12.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
